ShotPlotTerms of Use
1. What these terms cover
These terms are an agreement between you and Gux Digital about the ShotPlot app for iPhone and Android and the shotplot.io website (together, "ShotPlot"). By installing or using ShotPlot you accept them. If you do not accept them, do not use ShotPlot. Our Privacy Policy (shotplot.io/privacy) and our Consumer Health Data Privacy Policy (shotplot.io/health-data) explain how ShotPlot handles information and are part of these terms.
2. What ShotPlot is, and is not
ShotPlot is a logging and reminder tool. It records the injections and doses you tell it about, shows where you last injected on a body map, suggests a site you have not used recently, reminds you when a dose is due, keeps a stock count, tracks the weight you log (optionally read from Apple Health or Health Connect) with a smoothed trend and a projection toward a goal you set, and produces exports and a report from your own entries.
ShotPlot is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. It does not give medical advice. It does not calculate, convert or recommend doses, and it does not tell you what to do about a missed dose. It does not recommend a target weight or a rate of weight change: the goal, the pace and the milestones are numbers you enter, and the projection is arithmetic on your own trend, not a prediction of what will happen or advice about what should. The site suggestion is a rotation convenience based on your own log — the instructions of your prescriber and of the medication's label govern where, how and when you inject, and they take precedence over anything ShotPlot shows. Check with your clinician about where and how to inject, and talk to them before changing anything about your treatment.
ShotPlot is not an emergency service. If you think you have injected the wrong dose, or you have a reaction that worries you, contact your clinician, pharmacist or local emergency number.
3. Your responsibilities
- ShotPlot only knows what you enter. You are responsible for the accuracy of your entries and for checking them against your prescription.
- Reminders depend on your phone: its notification settings, battery settings, storage and operating-system rules. A reminder can be late, silent or missing for reasons outside our control. Do not rely on ShotPlot as your only safeguard for a dose that must not be missed.
- Your records live only on your phone. You are responsible for backups (Settings → Export backup). If you delete the app, reset the phone or lose it without a backup, the records are gone and we cannot recover them — we never had them.
- Keep your phone secure. The app lock is a convenience, not a guarantee.
- Use ShotPlot only for yourself or for someone whose care you are legitimately responsible for, and only as permitted by law.
ShotPlot is intended for people managing their own medications. It is not directed at children under 13, and we do not knowingly collect information from them.
4. Your license to use ShotPlot
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use ShotPlot on devices you own or control, for the purposes described in these terms, subject to the rules of the app store you got it from. You may not copy, modify, distribute, sell, rent, reverse-engineer or decompile ShotPlot except where the law lets you regardless of this clause, and you may not use ShotPlot's name, icon or artwork without our permission. Your entries are yours; we claim no rights in them.
5. ShotPlot Plus
ShotPlot's core — logging, reminders, the body map and site suggestion, every medication you take, your history, weigh-ins with the trend chart, backup and export, the app lock and stock alerts — is free. ShotPlot Plus is an optional, one-time in-app purchase that unlocks additional features described on the Plus screen in the app and at shotplot.io. It is not a subscription and does not renew.
- Who bills you. Plus is sold through Apple's App Store (on iPhone) or Google Play (on Android). Apple or Google process the payment under their own terms; the price you pay is the one they show you, in your local currency, and may include tax they collect. We never receive your payment details.
- Sold separately by platform. A purchase made on iPhone unlocks Plus on iPhones signed in to the same Apple Account (Family Sharing may extend it to your family group where Apple offers that); a purchase on Android unlocks Plus on Android devices signed in to the same Google account. A purchase on one platform does not unlock the other. There are no ShotPlot accounts, so we cannot move a purchase between platforms.
- Restoring. On a new phone, or after reinstalling, use Restore purchases on the Plus screen. Restoring a backup does not restore the purchase; the store does.
- Refunds. Refunds are handled by Apple or Google under their refund policies. We cannot issue App Store refunds ourselves. If a purchase is refunded or revoked, Plus features return to the free tier.
- Codes. We may give away Plus with offer or promo codes at our discretion. Codes are subject to the stores' terms and cannot be exchanged for money.
- Price changes. We may change the price of Plus for new buyers, including ending a launch price on the date the listing states. A price change never affects a purchase already made.
- Our promise about the free tier. We describe what is free and what is Plus in the app and on shotplot.io, and we intend not to move a feature that has shipped as free behind Plus. We may add features to either tier, and we may retire features with reasonable notice.
6. Changes to ShotPlot
We can update, change or discontinue ShotPlot or any part of it. Because ShotPlot keeps your data on your phone, an installed version keeps working after we stop updating it until your phone's operating system no longer runs it. If we ever add optional cloud features, they will be separately described and opt-in.
7. Third-party services and software
ShotPlot runs on Apple's and Google's platforms and uses their notification, billing and sharing services, which have their own terms. Files you export leave through your phone's share sheet to the app or service you choose, under that service's terms. ShotPlot includes open-source software under its own licenses; a list is available on request at hello@shotplot.io. ShotPlot is not affiliated with, endorsed by or sponsored by any pharmaceutical company; medication names are trademarks of their owners.
8. Disclaimer of warranties
ShotPlot is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, accuracy and non-infringement, to the fullest extent the law allows. We do not warrant that reminders will fire on time, that the app will be error-free or uninterrupted, or that the site suggestion is right for you. Some jurisdictions do not allow the exclusion of implied warranties, so some of this may not apply to you.
9. Limitation of liability
To the fullest extent the law allows, Gux Digital and its owner, contractors and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcome, missed or duplicated dose, or injury arising from your use of or inability to use ShotPlot, even if we were told it was possible. Our total liability for any claim relating to ShotPlot is limited to the greater of the amount you paid for ShotPlot Plus in the twelve months before the claim and US $25. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence where the law does not permit that limitation, or for fraud.
10. Termination
You can stop using ShotPlot at any time by deleting it; your data goes with it. We may end your license if you breach these terms. Sections 2, 3, 5 (refunds), 8, 9, 13 and 14 survive termination.
11. For iPhone users: terms Apple requires
These terms are between you and Gux Digital only, not with Apple Inc. ("Apple"); Apple is not responsible for ShotPlot or its content. Your license is limited to a non-transferable license to use ShotPlot on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that ShotPlot may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. Apple has no obligation to furnish any maintenance or support for ShotPlot. To the extent any warranty applies and is not disclaimed, you may notify Apple of a failure to conform to it and Apple will refund the purchase price you paid for the app, if any; to the maximum extent permitted by law Apple has no other warranty obligation, and any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our responsibility. We, not Apple, are responsible for addressing any claim by you or a third party relating to ShotPlot or your possession or use of it, including product-liability claims, claims that ShotPlot fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy or similar law. If a third party claims that ShotPlot infringes its intellectual-property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using ShotPlot. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. For Android users
Purchases on Android are made through Google Play and are subject to the Google Play Terms of Service and Google's refund policy. Google is not a party to these terms and is not responsible for ShotPlot.
13. Governing law and disputes
These terms are governed by the laws of the State of South Carolina and the federal law of the United States, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in South Carolina, except where the consumer-protection law of your home jurisdiction gives you rights that cannot be waived.
14. Changes to these terms
We may update these terms. The effective date at the top changes when we do, and the app shows a notice for changes that matter. Continuing to use ShotPlot after a change means you accept it. Earlier versions are available on request.
